This is really hard to write. Will try and make this short. Received a letter Wednesday from a finance company, saying they owned our Motorhome, we thought it was a scam, we tried phoning CamperNE, could not get through. After doing some searching found they have the receivers in. We then done a HPI check to find we had finance on our MH. Could not believe how shocked we were. We bought the MH at the caravan and Motorhome show at the NEC Birmingham, paid the deposit and they gave a price for our old MH.
A week later went to pick it up, paid the remainder in full, no finance a brand new MH.
2 1/2 years later we get the shock of our life. CamperNE did not pay of the finance. We always have done a HPI check when buying a private sale, whether a motorhome or cars, we never thought we needed to when buying new from a dealer again never any problem’s.
Now we are waiting to hear from the finance company how much is owed on it, assuming it’s the original price and now expecting to lose our MH.
Has anyone come across this before and has anyone ever or knows of anyone that has succeeded in keeping their vehicle without paying an exorbitant amount, do not have a lot of hope at the moment.
Please everyone if your not certain have a HPI check done on your vehicle whether it’s a second or new one(CamperNE put finance back onto some of the MH after it had cleared. These people have a better chance of keeping theirs. Ours had finance on from the beginning).
We did not pay with a credit card, bank transfers.
 
REALLY SAD TO READ THIS MAKES YOU WONDER IF IT IS BETTER TO HAVE FINANCE ON A VEHICLE ,GIVES YOU MORE POWER FOR ISSUES THAT MAY RISE ,REALKY HOPE IT ALL TURNS OUT GOOD FOR YOU IN THE END

That sound like fraud to me I’d get in touch with financial ombudsman. Had a similar thing happen with a car long story short I got to keep the car without paying extra was told if I tried to sell it or trade it it would still show on hpi because finance company lost out and wouldn’t remove it from database. Hope you get it sorted with no extra costs.
 
OMG what a shock

I think best advise is what wully said or even a solicitor . Fingers crossed all goes your way
 
This is the subject of a long thread on another forum. There are a couple of posters that believe they have a similar situation.

In some cases it looks like Stocking Finance had been raised after vans were sold, or when they went in for service.
 
That sound like fraud to me I’d get in touch with financial ombudsman. I believe the company directors may be facing charges. I will get in touch with the ombudsman after I see what the finance company want. That’s terrible that they would not remove the hpi because they lost out, vindictive and nasty spring to mind.
 
This is a terrible situation and I hope it gets resolved in your favour quickly.

Apart from the company directors possibly being criminal surely the finance company is in the wrong by allowing the dealer to finance a motorhome(s) with no evidence of it being in their stock ?

Phew! It would seem, no matter how you cover your backside. Horrendous story.

If this is the case then there should be nothing to worry about, because someone has taken out finance on a van that you already OWN , so looks like a case of fraud to me
 
How terrible for you! Maybe a call to trading standards might give you some help. Definitely feel that you have been victim of a fraud and should not lose the van. Couldn't quite understand if you paid by bank transfer or not, but surely you have proof of full payment from them. I would have thought it would be like when so done sells a stolen car, the original owner has the right to it not the person who bought it in good faith. You owned it and they raised money on it without your knowledge. I would stick to your guns and not offer to pay anything. The finance company were at fault giving money for something not owned by the person they were lending to.
 
Definitely sounds like deliberate fraud. Hope it eventually works out well for you.

If paid by credit card the card company would cover your losses. In my case the finance was on the van before we purchased it not after, if it was I would be alright as you said.

Very sorry to hear of your problem, an awful situation.

Was the vehicle pre registered by the dealer? I ask this because I have ordered a new motorhome and wonder whether a last minute hpi check would reveal any finance. The hpi checks seem to rely on the registration number and these are generally allocated late in the buying process, would the hpi records be instantly updated and how would the dealer raise finance on a new vehicle registered to the purchaser.

The law says that the dealer is at fault and he has to pay the finance not you. They are just trying it on just in case you pay up

Is that true? If the charge on the vehicle pre dates the invoice I would think it would take priority in law.
