Has anyone dealt with the above?
I purchased two LDC6-265-GC2 a week ago.
Chasing this morning I found they don't hold stock and haven't even ordered them!
So my money was taken when they did not have the goods. Fraud!

Not sure it's a fraud, they may dropship things like that to avoid delivery costs.

Anita is now having a horrible phone call with Ben.
They have not placed an order from the supplier.
It's only me chasing them, that I found out.
If you run a bedroom business and hold no stock it should be made clear.
If you are acting as an agent for a manufacturer it should be made clear.
As in this case they took money for a product they neither had or intended to supply!
Alternatives were offered, but I might as well have just placed an order for a "battery" and hoped it would be suitable.

I`ve had this happen, not from this company but it`s happening more and more these days.

The worst from a local company was over £1,000 for a summerhouse on the understanding it would be 7 - 14 days delivery.

Turned out they had no stock what so ever and it was a factory order and took over 6 bloody months to arrive.

They said we could have refund but we`d already spent another £500 on the extras / furniture / fittings we wanted and they were sat in our garage.

Annoying, but not Fraud, unless they have taken your money with no intention to supply the goods. Have you asked for a refund? Was it shown as in stock when you ordered it, if they had no stock when you ordered, they should really have told you when they expect stock or offered you a refund, but they may be working on a just in time supply chain and been let down by hold ups from their supplier.
If they could just be incompetent.

Your just making excuses for what is criminal behaviour, just because ”everyone “ does it. It doesn’t make it right.
With our business all orders are manually processed and funds are not taken until the day of dispatch.
We even try to make sure that our customers don’t buy what is not fit for their purpose, even if it means loosing a sale.
Just remember many businesses these days don’t tie their horses up at the front of the business!

Not making excuses, just saying their actions don’t amount to fraud.
Unlike your business, they seem to have little respect for you as a customer, but, so many businesses seem to trade like that nowadays.

The original test for Fraud in such cases was covered by Sections 14 & 15 of the Theft Act 1968 (amended by subsequent Theft Acts) , 'obtaining a pecuniary advantage by deception' where a successful prosecution would need to show a permanent intent to deprive the victim of the goods or services for which payment was tendered (R v Lambie 1974 and Metropolitan Police Commissioners v Charles 1976). Your post at 0954 yesterday would suggest that there is no fraud

Steve

I just remembered I ordered some very specific CBE AC Spurs from a company and I think I cancelled the order after possibly 12 months waiting for them! The supplier to the company kept putting back the delivery and I just held on hoping they would arrive eventually.
Not ideal but what was difference in this case compared to Marks situation from what I can gather is that the companty I placed the order with was generally upfront with the situation ("generally" as they were in the dark as well on delivery times for this product) and had no problems with processing any refunds when requested.

Illogical in light of your earlier post. Might be many things, but fraud ain't one of them ... 'Alternatives were offered' ...

Steve
I'm starting to think you've taken part in these criminal activities too? When I purchase steak, I don't want a sausage!

I don't suppose you paid by credit card? If so just advise them and get your money back that way?
Good luck
K ;)

I think many of you are missing the point.
All is resolved now.
My point was that my money was taken for something they did not have. Yes this is common but still wrong if they don't make it clear on their web site.
What makes it worse is that they held my money for a week which could have been more if I hadn't enquired as to the whereabouts of my order.
At this point I discovered they had not even placed an order with their suppliers.
Then it escalates to they can't supply for some months to come.
Kindly they can help me by supplying some lower spec batteries.

This is the cleaned up version as I was incensed by their attitude and had pass it over to Anita to conclude.
It horrifies me that some people think this is acceptable behaviour.

A simple email along the lines of...
I'm very sorry we are unable to fulfill your order, we can refund your monies or you are welcome to discus with us other options.

I understood your point but I have found it is more common than you might think. Doesnt make it better, but it is not usual sadly.

As an aside, I am in the middle of shifting loads of stuff around at the moment and cannot access a lot of my tools & kit easily and for that reason, I have actually put my own on-line shop in "Vacation" mode so people cannot just go on and buy something, and then I have to tell them I cannot supply for x days or y weeks and refund their money if they don't want to wait, which in itself is an expense, so everyone loses out :( .
I am still selling things during this time but only after a brief email conversation each time where I can set their expectations appropriately and only then if they are happy, invoice them for the kit they want.
