If it’s purchased from a dealer then it is his charge. If it is purchased privately then it is your responsibility so as long as you have the paperwork work to show purchase from the dealer then no problem

I wish that were true but I don’t think it is. The charge is on the vehicle.
 
I remember some years ago, a similar thing involving a man selling tractors. He somehow sold a tractor then had finance on it & it got complicated involving lots of tractors,combines & machinery. Tales went round of finance repo men turning up in fields & snatching back machinery in the middle of harvest time. Terrible thing to be going through, hope it works out.
 
As long as you have all the paperwork to show you didn’t know it had finance on it before you purchased it then you bought it in good faith and it is up to prove that you knew not the other way round

The dealer has gone into receivership, so problem is finance company wanting their money.

Very sorry to hear of your problem, an awful situation.

Was the vehicle pre registered by the dealer? I ask this because I have ordered a new motorhome and wonder whether a last minute hpi check would reveal any finance. The hpi checks seem to rely on the registration number and these are generally allocated late in the buying process, would the hpi records be instantly updated and how would the dealer raise finance on a new vehicle registered to the purchaser.

Thank you for alerting us all to this problem and I hope you get it sorted out in your favour very quickly.
In hindsight I would get the dealer to show you the HPI when you pick the vehicle up and again a week or so later. I’m not sure if the records are updated immediately, hence why I would check again later.

I expect you have the registration Document with you with the vehicle in your name.
That should convince the police that anyone attempting to take it would be regarded as theft.

I suspect only a court repossession would count and you can challenge that..AND I HOPE WIN.

Sounds like the finance was taken out any time from new ,to any time in the last 2 1/2 years ,being a dealer I doubt that you are the only one . I would contact the police as a crime has been committed and you are the victim .I hope you have a satisfactory outcome.

This is really hard to write. Will try and make this short. Received a letter Wednesday from a finance company, saying they owned our Motorhome, we thought it was a scam, we tried phoning CamperNE, could not get through. After doing some searching found they have the receivers in. We then done a HPI check to find we had finance on our MH. Could not believe how shocked we were. We bought the MH at the caravan and Motorhome show at the NEC Birmingham, paid the deposit and they gave a price for our old MH.
A week later went to pick it up, paid the remainder in full, no finance a brand new MH.
2 1/2 years later we get the shock of our life. CamperNE did not pay of the finance. We always have done a HPI check when buying a private sale, whether a motorhome or cars, we never thought we needed to when buying new from a dealer again never any problem’s.
Now we are waiting to hear from the finance company how much is owed on it, assuming it’s the original price and now expecting to lose our MH.
Has anyone come across this before and has anyone ever or knows of anyone that has succeeded in keeping their vehicle without paying an exorbitant amount, do not have a lot of hope at the moment.

We did not pay with a credit card, bank transfers.

However I believe in that case the loan and the charge were fraudulently taken out sometime after the sale, possibly while the vehicle was in for servicing. I think the owner was able to prove that their paid invoice pre dated the loan so the finance company backed down. @MadRssss I hope this gives you something to build your case on.
 
We were have been regular customers of Camper NE for over 6 years and bought our first NEW Hobby from them last May. There was a degree of delay before we picked it up having paid an initial holding deposit in cash and paid the balance by bank transfer. Should we be worried?

What a horrendous tale, I can’t begin to think how I’d behave in your situation (legally that is) . I only hope that common sense will prevail and be quickly sorted in your favour.

Logic says that it was the dealer's signature on the finance agreement whereas you have proof you paid in full. Surely that makes the dealer the defaulter? It's seems so unfair that a debt can be passed on with a brand new vehicle!
Fingers crossed that someone can untie the legal knots in your favour. Well worth getting good legal advice in case there are special laws around undisclosed dealership debt on new vehicles specifically. I wish you all the luck in the world.
